These Terms and Conditions govern your use of FastTrack Pro LLC’s platform, software tools, AI systems, automations, templates, and all related services. By accessing or using the platform, you agree to comply with the terms below.
Welcome to FastTrack Pro LLC. By subscribing to, accessing, or using any of our services, tools, systems, or platforms, you agree to abide by the following terms and conditions. These terms constitute a legally binding agreement between you and FastTrack Pro LLC and supersede all prior agreements, understandings, or representations.
1. Platform Access & Use
Authorized Use
Your access to FastTrack Pro LLC includes permission to use tools, templates, automation workflows, and AI-powered resources exclusively for your personal real estate business while you maintain an active, paid subscription in good standing.
Prohibited Use
Any unauthorized use, duplication, sharing, distribution, or commercialization of these materials is strictly prohibited and constitutes a material breach of this agreement.
User Responsibilities
You agree to:
Use the platform only for legitimate real estate business purposes
Maintain the confidentiality of your account credentials
Immediately notify us of any unauthorized access to your account
Comply with all applicable laws and regulations in your use of the platform
2. Intellectual Property & Licensing Rights
Ownership and Proprietary Rights
All content, workflows, automations, calculators, templates, websites, tools, funnels, lead magnets, agent dashboards, training systems, email/SMS sequences, branding assets, AI assistants, AI configurations, proprietary algorithms, source code, trade secrets, and any other materials, systems, or digital assets provided through or within your FastTrack Pro LLC account (collectively, "Proprietary Materials") remain the sole and exclusive intellectual property of FastTrack Pro LLC and its licensors.
Licensed Use Only
The Proprietary Materials are licensed to you solely for your personal real estate business use within the FastTrack Pro platform. This license is:
Non-exclusive
Non-transferable
Non-sublicensable
Revocable at any time
Terminates immediately upon account termination, breach of these terms, or non-payment
Prohibited Activities
You are strictly prohibited from engaging in any of the following activities without express written permission from FastTrack Pro LLC:
Duplication and Distribution Restrictions
Duplicating, copying, cloning, replicating, or reproducing any Proprietary Materials
Reselling, redistributing, sublicensing, or commercializing any part of the system
Sharing, transferring, or providing access to any Proprietary Materials with third parties
Creating derivative works based on any Proprietary Materials
Allowing others to access your account or use materials through your account
Technical and Code Restrictions
Reverse-engineering, decompiling, disassembling, or attempting to derive source code
Copying, extracting, or replicating any code, including but not limited to CSS, HTML, JavaScript, or embedded scripts
Using web scraping, data mining, automated extraction tools, or bots on any platform content
Bypassing, circumventing, or disabling any security measures, access controls, or digital rights management
Attempting to access restricted areas of the platform or underlying systems
Platform and Asset Migration Restrictions
Exporting, downloading, or extracting funnel or page templates outside the platform
Using snapshots, screenshots, screen recordings, printing, or replication tools to migrate assets
Extracting, sharing, or reverse-engineering workflows, automations, or AI configurations
Creating backup copies or mirrors of any Proprietary Materials outside the authorized platform
Using third-party tools or services to capture or replicate platform functionality
AI and Automation Restrictions
Copying, replicating, or extracting AI assistant configurations, prompts, training data, or algorithms
Using AI-generated content from the platform for purposes outside your licensed real estate business
Attempting to recreate, duplicate, or reverse-engineer AI functionalities provided within the platform
Sharing AI assistant outputs, configurations, methodologies, or training approaches with competitors or third parties
Training other AI systems using content or outputs from our platform
Competitive Intelligence and Business Restrictions
Using the platform to benefit competitors or competing businesses
Conducting competitive analysis or benchmarking using our Proprietary Materials
Sharing insights, strategies, or methodologies derived from the platform with industry competitors
Using platform data or analytics to create competing products or services
Enhanced Protection Measures
FastTrack Pro LLC employs advanced monitoring, tracking, watermarking, fingerprinting, and security technologies to protect its intellectual property. Any attempt to circumvent these protections or engage in prohibited activities may be detected and will result in immediate consequences.
Enforcement and Legal Remedies
Violation of any provision in this section constitutes:
Material breach of your licensing agreement
Intellectual property infringement under applicable laws including the Digital Millennium Copyright Act (DMCA)
Grounds for immediate legal action, including but not limited to: Injunctive relief to prevent further violations Monetary damages, including actual damages, lost profits, and statutory damages up to $150,000 per work infringed Treble damages for willful infringement Attorney's fees and costs Criminal referral for willful infringement where appropriate Seizure of infringing materials and devices
Immediate Consequences of Violation
Any violation of these terms will result in:
Immediate account termination without refund or notice
Permanent ban from all FastTrack Pro services and affiliated platforms
Legal action for damages and injunctive relief
Reporting to appropriate authorities for potential criminal prosecution
Public disclosure of violations where legally permissible
Monitoring and Detection
You acknowledge and consent that FastTrack Pro LLC may monitor your use of the platform and Proprietary Materials to ensure compliance with these terms. This includes, but is not limited to:
Tracking downloads and usage patterns
Implementing digital rights management technologies
Monitoring IP addresses and device fingerprints
Recording user activities and interactions
Using AI and machine learning to detect unauthorized use
Acknowledgment and Agreement
By accessing, using, or maintaining an account with FastTrack Pro LLC, you explicitly acknowledge that you have read, understood, and agree to be bound by these intellectual property and licensing terms. You further acknowledge that these restrictions are reasonable and necessary to protect FastTrack Pro LLC's valuable intellectual property rights and competitive position in the marketplace.
3. Retargeting & Analytics
By visiting our pages, entering information, or using our services, you consent to:
Standard tracking tools (e.g., retargeting pixels, cookies, web beacons) being used to improve user experience and advertising relevance
Collection and analysis of usage data for platform optimization
Retargeting advertisements on third-party platforms
Privacy Protection: No personally identifiable information is ever sold or shared with third parties without explicit consent, except as required by law or to protect our rights.
4. Account Cancellation & Termination
Immediate Revocation Upon Termination
Upon cancellation, expiration, non-payment of your subscription, or termination for any reason:
Your access to the FastTrack Pro LLC platform and all included services will be revoked immediately without notice
You will lose access to your CRM, landing pages, automations, AI tools, custom configurations, and all associated data
No funnels, workflows, digital tools, or data may be exported, downloaded, or retained beyond the platform
All user-generated content within the platform becomes inaccessible
Proprietary Asset Protection
All digital assets, templates, proprietary tools, and custom configurations provided within or created through FastTrack Pro LLC remain the exclusive property of FastTrack Pro LLC and may not be:
Extracted, cloned, duplicated, shared, transferred, or repurposed outside the platform under any circumstances
Used to create competing products or services
Shared with or sold to third parties
Strict Export Prohibition
Any attempt to download, export, reverse engineer, screenshot, print, or replicate the code, design, structure, or functionality of landing pages, CSS, embedded scripts, AI workflows, automations, or any other platform components is strictly prohibited and will result in:
Immediate legal action seeking injunctive relief and monetary damages
Permanent account ban across all FastTrack Pro services
Criminal referral where applicable
License Termination
By using FastTrack Pro LLC, you agree that all tools, configurations, intellectual property, system logic, and methodologies provided are licensed for use within the platform only and are not for redistribution, external deployment, or use beyond the subscription period.
Data Retention and Deletion
Upon account termination:
Your access to all data is immediately revoked
FastTrack Pro LLC may retain data as required by law or for legitimate business purposes
No obligation exists to provide data exports or backups
All rights not expressly granted herein are reserved by FastTrack Pro LLC
5. Refund Policy
All subscriptions are billed in advance and are non-refundable. You may cancel your subscription at any time; however, no prorated refunds will be issued for unused time. All sales are final unless otherwise stated in a specific offer.
If you believe you were billed in error, please contact our support team at [email protected] within 7 days of the charge for resolution.
6. Marketing Consent
By submitting your information through any FastTrack Pro form, calculator, lead magnet, or funnel, you consent to receive communications from us via email, SMS, or phone in accordance with applicable laws. These may include marketing messages, transactional updates, and system notifications. Message and data rates may apply. You may opt out at any time by following unsubscribe instructions provided in communications.
7. Limitation of Liability & Disclaimers
Service Disclaimer
THE PLATFORM AND ALL SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Limitation of Liability
FastTrack Pro LLC shall not be liable for:
Any business loss, revenue decrease, or performance issues resulting from the use or discontinuation of our services
Indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, use, goodwill, or other intangible losses
Damages resulting from unauthorized access to or use of our servers and/or personal information stored therein
Maximum Liability Cap
In no event shall FastTrack Pro LLC's total liability exceed the amount paid by you for the service in the twelve months preceding the claim.
Force Majeure
FastTrack Pro LLC is not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, or government actions.
8. Indemnification
You agree to indemnify, defend, and hold harmless FastTrack Pro LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:
Your use of the platform or services
Your violation of these terms
Your violation of any third-party rights
Any content you submit, post, or transmit through the service
9. Dispute Resolution
Binding Arbitration
Any dispute arising out of or relating to these terms shall be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association.
Class Action Waiver
You agree that any arbitration or legal proceeding shall be limited to the dispute between you and FastTrack Pro LLC individually. You waive any right to participate in class action lawsuits or class-wide arbitrations.
Governing Law
These terms shall be governed by and construed in accordance with the laws of [Your State], without regard to conflict of law principles.

Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Governing Law: Florida

Platform notification upon login

Continued Use Constitutes Acceptance
Continued use of FastTrack Pro LLC services after any modification constitutes acceptance of the revised terms. If you do not agree to modified terms, you must discontinue use immediately.
Regular Review Requirement
You are required to review these terms periodically and are responsible for being aware of any modifications.
11. Severability & Entire Agreement
Severability
If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these restrictions will otherwise remain in full force and effect.
Entire Agreement
These terms constitute the entire agreement between you and FastTrack Pro LLC and supersede all prior agreements, understandings, or representations, whether written or oral.
No Waiver
Failure by FastTrack Pro LLC to enforce any right or provision in these terms will not constitute a waiver of such right or provision.
